GenomNZ Track and Trace Web App Terms of Use

These Terms of Use (“Terms”) govern your use of the GenomNZ Track and Trace web app (“the web app”). If you are using the web app on behalf of a company or other legal entity, you represent that you have the authority to do so and all reference to “you” or “your” will refer to that entity.

In these Terms, reference to “we”, “us” or “our” are references to AgResearch Limited.

There is no fee or charge to use the web app and you are not required to create an account or register your personal information with us in order to use the web app.

We may change or update the content of the web app or these Terms at any time without notice. Your continued use of the web app constitutes acceptance of the amended Terms.

User Obligations: You agree to comply at all times with any instructions for use of the web app which are made available. You assume sole responsibility for information and data obtained or generated from use of the web app and for conclusions drawn or actions taken as a result of such information and data.

You must:

(a) Access the web app via standard web browsers only and not by any other methods;

(b) Not act in a way or use or introduce anything that in any way compromises or may compromise the web app, or otherwise attempt to damage or interfere with the web app;

Disclaimer: We exclude any warranty as to the completeness, accuracy or continuity of any information provided via the web app, except to the extent that such exclusion is prohibited by law. The information provided via the web app is made available solely for information purposes. We disclaim all liability and responsibility arising from any reliance placed on such information by you. To the extent permitted by law, neither AgResearch nor any of its directors, officers, employees or agents will have any liability, whether in negligence or otherwise, for any loss, damage, costs or expenses arising directly or indirectly from anything contained in this web app or from any use of this web app.

Intellectual Property: All intellectual property rights (including copyright) in the web app and its content, are owned by or licensed to AgResearch. All rights are reserved.

Privacy: We do not directly collect or store any personal information from you when use the web app. We do not require you to register an account or log in with personal information. If you provide us with any personal information through this web app or our systems (eg by emailing us via the [email/link] below, we will use it only in relation to the purpose for which it was provided and as described below. You have the right to inspect and update any of your personal information at any time while it is held by us. We will not provide personal information about any individual web app user to any third party unless we have obtained their consent or we believe there is a need to disclose for law enforcement purposes.

Security: We use security measure on our web app and systems to help prevent and mitigate the loss, misuse and unauthorized access to information under our control. As part of this, the web app and our systems are subject to monitoring, analysis and auditing, which may include in relation to your use of the web app.

Miscellaneous: If any part of these terms is held to be invalid or unenforceable, the remaining parts will continue in full force and effect. A waiver by either party of any breach does not constitute a waiver of any other breach. These terms and any access to or use of the website are governed by and must be interpreted in accordance with the laws of New Zealand.
